Debt Collection Agencies vs. Debt Collection Departments
Debt collection agencies have been given authorization by a creditor to collect a
debt as a third party, and special rules apply by the Federal Debt Collection Practices
Act (FDCPA). However, many companies have an internal billing and collections department,
such as most credit card companies, that will attempt to directly collect money from
you. These debt collection departments are not subject to all of the restrictions
on of the FDCPA (for example, they can call you at work unless you ask them to stop),
but they cannot verbally threaten you and they must not contact you if you involve
an attorney or have declared bankruptcy.
Many debt collection agencies have simply purchased defaulted loans and debts for
pennies on the dollar and try to collect by repeatedly calling debtors, effectively
operating as call centers for bill collection. The employees making calls for the
debt collection companies can be paid more when they collect form debtors - and this
incentive, coupled with poor training and lack of supervision, leads to some debt
